The following processes are only for EB-1A, EB-1B and NIW cases. Please contact us for other processes.

I. Free Evaluation

a.    Petitioner sends CV via email to attorney for free initial evaluation. You may indicate which category you are interested.

b.    Attorney reviews CV and evaluates whether your credentials meet the minimum requirements for EB-1A/B or NIW and an approximate chance to get approved

II. Follow-Up Communications

a.    Petitioner and attorney clarify some preliminary questions and concerns.

III. Choose a Service

a.   Petitioner chooses one of three service options (DIY Service, Regular Service and Premium Service). Please carefully read the following  notes before you choose one. 

Notes: As of the DIY Service, petitioner needs to prepare all filing documents by himself/herself. Attorney will provide instruction with samples and general legal advice, review all filing documents, and file the whole petition. In case of receiving Request for Evidence, attorney will provide advice on how to response, and review and file response package.

As of the Regular Service, petitioner needs to provide required documents, supporting materials and drafted reference letters. Attorney will provide instruction with samples and legal advice, review and revise reference letters, prepare the petition letter and forms, and file the whole petition. In case of receiving Request for Evidence, attorney will prepare and file the response package with petitioner's cooperation.

As of the Premium Service, petitioner needs to provide required documents, supporting materials, a list of references and background summary. Attorney will prepare and file the whole petition. In case of receiving Request for Evidence, attorney will prepare and file the response package with petitioner's cooperation.  

IV. Create Attorney-Client Relationship

a.    Attorney sends the Attorney-Client Agreement according to the selected service to petitioner via email. 

b.    Petitioner carefully read the Agreement and communicates with attorney if need to make any change or clarify any term.  

c.    Petitioner signs the Agreement and mails it back with payment check of initial legal Fee. Please don't mail cash.

d.    Attorney signs the Agreement after receives the petitioner-signed Agreement and payment of initial legal fee. The Attorney-Client relationship is established.

e.    Attorney mails a photocopy of the both-signed Agreement and receipt of payment to client.  

V. Process the Case (For Regular Service)

a.    Attorney sends the instruction and sample package to client. The package includes a List of Required Personal Documents, Instruction on How to Collect Supporting Materials, Writing Instruction of Recommendation Letter, Samples of Recommendation Letter, etc.

b.    Client submits drafted recommendation letters and supporting materials.

c.    Attorney reviews and revises recommendation letters.

d.    Client submits signed recommendation letters and all required documents according to attorney's instruction.

e.    Attorney prepares petition letter and all forms, and sends forms to client for review and signature.

f.     Attorney files and tracks the case, and informs client with case number and any update.

g.    In case of receiving Request for Evidence (RFE), attorney will immediately notify client regarding the content of the RFE notice. Attorney advises client on how to prepare response. Attorney writes and files response letter with additional documents if any.   

VI. Obtain Case Result

a.    If the case gets approved, attorney will notify client immediately. Client should mail contingent legal fee as soon as possible. After receiving full payment, attorney will mail approval notice to client upon request.

b.    If the case gets denied, attorney will notify client immediately and advice client with available relief options, such as appeal. Client makes decision whether to appeal or pursue other options.
